Terms of Use

The Fanos website, located at https://fanoslms.org (the "Site"), is a copyrighted work belonging to HaHuJobs, in partnership with the STEM Education for Empowerment Project (Fanos). HaHuJobs ("Company") operates this Site. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

These Terms of Use describe the legally binding terms and conditions that govern your use of the Site. BY ACCESSING OR USING THE SITE, YOU ARE AGREEING TO BE BOUND BY THESE TERMS, and you represent that you have the authority and capacity to enter into these Terms. YOU SHOULD BE AT LEAST 14 YEARS OF AGE TO ACCESS THE SITE. IF YOU DISAGREE WITH ALL OF THE PROVISIONS OF THESE TERMS, DO NOT ACCESS OR USE THE SITE.

These Terms require the use of arbitration as outlined in Section 10.2 on an individual basis to resolve disputes and also limit the remedies available to you in the event of a dispute.

1. Access to the Site

1.1 Subject to these Terms

Company (HaHuJobs, on behalf of the STEEP project) grants you a non-transferable, non-exclusive, revocable, limited license to access the Site solely for your own personal, noncommercial use related to the STEEP project's objectives.

1.2 Certain Restrictions

• You shall not sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site.
• You shall not change, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Site.
• You shall not access the Site in order to build a similar or competitive website.
• No part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted without retaining all copyright and proprietary notices.

1.3 Modification or Discontinuation

Company reserves the right to change, suspend, or cease the Site with or without notice to you. You agree that Company will not be held liable to you or any third-party for any change, interruption, or termination of the Site or any part.

1.4 No Support or Maintenance

You agree that Company will have no obligation to provide you with any support in connection with the Site.

1.5 Ownership of Intellectual Property

Excluding any User Content that you may provide, all intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Site and its content are owned by Company or its suppliers. These Terms do not grant you any rights, title, or interest in or to any intellectual property rights, except for the limited access rights expressed in Section 1.1. Company and its suppliers reserve all rights not granted in these Terms.

2. User Content and Data Collection for Project Purposes

2.1 User Content

"User Content" includes text, photos, videos, audio, testimonials, and other electronic images submitted to or through the Site. You are exclusively responsible for your User Content and bear all risks associated with its use. You certify that your User Content does not violate our Acceptable Use Policy. You may not imply that your User Content is provided, sponsored, or endorsed by Company or the STEEP project. Company is not obligated to back up your User Content, and it may be deleted at any time without notice.

2.2 License to User Content for STEEP project

By submitting User Content, you grant HaHuJobs and its partners a royalty-free, non-exclusive, irrevocable, worldwide license to use your content for promoting, advertising, and sharing project updates related to the STEEP project. This includes use across websites, social media, published documents, campaigns, trainings, workshops, and partner platforms. You waive any claims of moral rights or attribution for these purposes.

2.3 Acceptable Use Policy

• You agree not to upload content that violates third-party rights, intellectual property, or proprietary rights.
• You agree not to upload unlawful, harassing, abusive, harmful, invasive, vulgar, defamatory, false, misleading, or offensive content.
• You agree not to upload content harmful to minors or in violation of laws, regulations, or third-party obligations.

2.4 Enforcement of Acceptable Use Policy

We reserve the right to review, remove, or take action against violators of the policy, including terminating accounts and reporting offenders to law enforcement authorities.

2.5 Feedback

Any feedback or suggestions provided to Company are assigned to Company and treated as non-confidential and non-proprietary.

3. Indemnification

You agree to indemnify and hold Company harmless from any claims or damages arising from your use of the Site, violation of these Terms, or your User Content.

4. Third-Party Links & Ads; Other Users

4.1 Third-Party Links & Ads

The Site may contain links to third-party websites and services. Company provides access to these links as a convenience but does not control or endorse them. Use third-party links at your own risk.

4.2 Other Users

Each user is solely responsible for their own User Content. Company is not liable for interactions between users or disputes.

4.3 Release

You release and discharge Company from any past, present, or future claims related to the Site.

5. Cookies and Web Beacons

The Site uses cookies to store visitor preferences and optimize user experience based on browser type and other information.

6. Disclaimers

THE SITE IS PROVIDED "AS-IS" AND "AS AVAILABLE." COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. COMPANY DOES NOT GUARANTEE THAT THE SITE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, ACCURATE, RELIABLE, FREE OF VIRUSES, COMPLETE, LEGAL, OR SAFE.

7. Limitation on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY'S LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT WILL BE LIMITED TO $50 USD. COMPANY IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.

8. Term and Termination

These Terms remain in effect while you use the Site. Company may terminate your access for violations of these Terms. Upon termination, your Account and User Content may be deleted, and Company will not be liable for any termination.

9. Copyright Policy

Company respects intellectual property rights and will act on valid DMCA notices. Submit infringement claims to the designated Copyright Agent.

10. General Provisions

10.1 Revisions to Terms

These Terms may be revised occasionally, with changes effective upon notice via email or posting on the Site.

10.2 Dispute Resolution

Disputes must be resolved through mandatory binding arbitration on an individual basis, with a waiver of class actions.

10.3 Governing Law

In cases where arbitration is not applicable, disputes will be governed by the courts located in Addis Ababa, Ethiopia.

10.4 Export Control

You agree to comply with export control laws and not export or re-export technical data acquired from Company in violation of applicable laws.

10.5 Electronic Communications

Communications between you and Company are conducted electronically, and you consent to receive electronic communications.

10.6 Entire Terms

These Terms constitute the entire agreement between you and Company regarding the use of the Site.

10.7 Your Privacy

Your privacy is governed by our Privacy Policy, which is incorporated by reference.

10.8 Copyright/Trademark Information

All trademarks, logos, and service marks displayed on the Site are the property of Company or third parties. You are not permitted to use these Marks without prior written consent.
